NSAC Statement on SB 343 “Truth in Recycling” Lawsuit

The National Stewardship Action Council views California’s SB 343 as a necessary step toward restoring integrity and trust in the recycling system.

 

Misleading recyclability claims have long contributed to consumer confusion, increased contamination, and higher system costs for communities and ratepayers. When labels do not reflect real-world outcomes, they undermine trust and make it harder for recycling systems to function as intended.

 

Labels on a package are often the last decision point for the public, who want to make informed choices about how to properly dispose of materials. That information needs to be clear, consistent, and grounded in reality.

 

Recycling only works when materials are turned into new products and packaging. That begins with design and continues through the public’s decision point at disposal. Cleaner material streams are essential to building stronger, more resilient recycling systems and supporting domestic end markets.

 

SB 343 aligns recyclability claims with real-world conditions. This approach is consistent with longstanding legal precedent allowing governments to restrict misleading commercial claims and protect consumers.
